1. Acceptance of terms

By accessing or using livedhere.world (“the Service”, “the site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

2. Description of the service

livedhere.world is a platform that allows people to discover and share first-hand memories and recollections from homes and addresses — including properties where notable or famous people have lived. The Service includes browsing property memories, submitting your own memories, uploading photos, and searching for addresses or notable people.

3. Eligibility

You must be at least 13 years old to use the Service (or 16 years old if you are located in the European Economic Area). By using the Service, you confirm that you meet this requirement. If you are under 18, you confirm that you have obtained permission from a parent or legal guardian.

4. Your account

To submit content, you must create an account. You are responsible for:

• Keeping your login credentials secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access

You may not share your account with others or create accounts on behalf of someone else without their permission. We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to use the Service to:

• Post false, defamatory, misleading, or deliberately inaccurate content
• Harass, threaten, or harm any individual
• Violate anyone’s privacy or post personally identifiable information about others without their consent
• Post content that is illegal, obscene, or incites hatred or violence
• Infringe any copyright, trademark, or other intellectual property rights
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use automated tools (bots, scrapers, crawlers) to access the Service without our prior written permission
• Attempt to gain unauthorised access to any part of the Service or its systems
• Use the Service for commercial solicitation, spam, or advertising without our permission

7. Intellectual property

All content on the Service that is not User Content — including the site design, brand, code, copy, and original images — is owned by or licensed to livedhere.world and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or distribute this content without our express written permission.

8. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-party services

The Service uses third-party services including Google Maps and Places API for address search. Your use of those features is also subject to Google’s Terms of Service and Privacy Policy. We are not responsible for the practices of any third-party service providers.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not verify the accuracy of User Content — memories and information submitted by users reflect their personal recollections and opinions, not established fact.

11. Limitation of liability

To the maximum extent permitted by applicable law, livedhere.world and its operators, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) $100 AUD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability — in such jurisdictions our liability is limited to the extent permitted by law.

You agree to indemnify, defend, and hold harmless livedhere.world and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

You may stop using the Service at any time and delete your account via the site. We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

Upon termination, the provisions of these Terms that by their nature should survive — including intellectual property rights, disclaimers, and limitations of liability — will continue to apply.

We may update these Terms from time to time. We will post the updated Terms on this page with a revised “last updated” date. For material changes, we will notify you by email or prominent notice on the site. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Governing law and disputes

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be subject to the non-exclusive jurisdiction of the courts of New Zealand.

If you are a consumer in the EU or UK, you may also have rights under the mandatory consumer protection laws of your country of residence.
